TERMS & CONDITIONS & AGREEMENT OF SERVICES
(SCOPE OF SERVICES)
I understand that the services provided by usadivorcedparents may not be covered by insurance benefits, third-party reimbursement, or employer benefits. This program does not provide treatment for mental illnesses, diagnosis of neurological or psychiatric, or psychological disorders. This program does not offer medical treatment or legal services.
During this contract with CLIENT, usadivorcedparents shall perform duties faithfully, diligently, and to the best of our ability. usadivorcedparents does not guarantee the outcome of services.
usadivorcedparents does not provide psychotherapy, psychoanalysis, or psychiatric services. The confidential services herein provided are designated in this signed agreement of services.
WHEREAS, usadivorcedparents, agrees to contract services with CLIENT, effective this date in the position of Parenting Educator/Parent Advocate and shall perform all duties and services necessary, required, requested, or advisable to fulfill the duties of the contract to the best of its ability.
This document is not a psychological evaluation, nor a court ordered child custody evaluation or therapy. These services are not meant as a replacement for legal or medical services deemed necessary by a court of competent jurisdiction.
By accepting the terms and conditions of this Agreement, Client represents and warrants that (a) the person accepting this agreement on behalf of customer is 18 years of age or older, (b) all information Client has provided to usadivorcedparents, is true and correct in all respects, and (c) Client will provide usadivorcedparents, by email with any changes to information that Client has previously supplied. Client further represents and warrants that Client has legal authority to accept the terms and conditions of this Agreement and that such acceptance will be binding by Client.
WHEREAS, both CLIENT and usadivorcedparents agree to embody the terms and conditions of the contract in this written agreement which supersedes all prior agreements whether written or oral;
NOW, THEREFORE, in consideration of the mutual terms and conditions hereinafter set forth, the parties hereto agree as follows:
1. TERMS OF SERVICE:
1.1 CLIENT and usadivorcedparents agree that any agreement to modify the at-will status of services must be in writing and fully executed by both parties.
2. DUTIES:
2.1 During usadivorcedparents contract with CLIENT, usadivorcedparents shall perform duties faithfully, diligently and to the best of usadivorcedparent’s ability. usadivorcedparents does not guarantee what the outcome of service will be throughout and after services, nor does usadivorcedparents guarantee the outcome of any other factors associated with the service.
3. CANCELLATION\NON-REFUND POLICY:
3.1 This agreement of service has a no-refund policy. Upon cancellation of this agreement for any reason, all rights and obligations of the parties under this agreement shall be extinguished, except that all payment obligations hereunder shall survive such termination.
4. CONFIDENTIALITY:
4.1 usadivorcedparents agrees to maintain the privacy and confidentiality of said information and will not disclose, release, or in any way divulge any and all information discussed above, learned, received, or generated through contract with CLIENT to any third person, directly or indirectly, or use said information in any manner, whether during the contract or anytime thereafter except as may be required in the course and scope of the contract, or by CLIENT’S written consent.
5. INTELLECTUAL PROPERTY
5.1 usadivorcedparents. The parties agree that usadivorcedparents owns and retains all right, title and interest to the Trademarks, including but not limited to all intellectual property rights associated therewith.
By clicking on the “I AGREE” button or a similar affirmation, or by acknowledging acceptance of the Agreement by any other method allowed by usadivorcedparents. Client acknowledges and agrees that: (a) it has reviewed and understands the Agreement; (b) it agrees to be legally bound by the terms and conditions of the Agreement; and (c) it’s use of usadivorcedparents Services and any related products or services will be governed by this Agreement. If Client does not agree or is not willing to be bound by the terms and conditions of this Agreement, Client should not click on the “I AGREE” button and should not seek to obtain or use usadivorcedparents Services.
